Welcome to BluePay. By accessing or using our website and mobile application ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our Services.
1. Acceptance of Terms
By creating an account or using BluePay's payment and financial services, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.
2. Description of Services
BluePay provides payment solutions, including but not limited to B2B and B2C payments, e-wallet functionality, and financial analytics. We reserve the right to modify, suspend, or discontinue any part of the Services with reasonable notice where practicable.
3. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use our Services. By using our Services, you represent that you meet these requirements and that all information you provide is accurate and current.
4. Account and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use. We are not liable for losses arising from unauthorized use of your account.
5. Acceptable Use
You agree not to use the Services to:
- Violate any applicable law or regulation.
- Infringe the rights of others or engage in fraud or illegal activity.
- Transmit malware or interfere with the integrity of our systems.
- Use the Services for any purpose that is harmful, abusive, or prohibited by these Terms.
We may suspend or terminate your access if we believe you have violated these Terms.
6. Fees and Payments
Fees for our Services will be disclosed to you before you complete a transaction or subscribe to a paid feature. You are responsible for any taxes applicable to your use of the Services. We may change fees with reasonable notice where required by law.
In-app purchases (Apple)
If you make in-app purchases through our iOS app, payment is processed by Apple. Refunds and cancellation requests for such purchases must be made through Apple's refund process (e.g. report a problem in your purchase history). We do not control Apple's refund policy.
7. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUEPAY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Indemnification
You agree to indemnify and hold harmless BluePay and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services or your violation of these Terms.
10. Termination
We may terminate or suspend your access to the Services at any time for any reason, including breach of these Terms. You may close your account at any time by contacting us. Upon termination, your right to use the Services ceases, and we may delete your data in accordance with our Privacy Policy.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which BluePay operates, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.
12. Changes
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Services after changes constitutes acceptance of the updated Terms.
